Effective date: 11 September 2026 Welcome to k1ndly.com, operated by K1ndly LLC (“K1ndly,” “we,” “us”). By accessing or using our Site or placing an order, you agree to these Terms of Service. Please read them carefully. 1. Eligibility You must be at least 18 years old, or use the Site under the supervision of a parent or guardian, to make a purchase. 2. Our products K1ndly sells pre-owned and secondhand clothing and accessories. Most items are one-of-a-kind, and quantities are limited. We describe each item’s condition as accurately as possible with photos and measurements, but pre-owned items may show normal signs of wear. Colors may appear slightly different depending on your screen. Items are sold as described. 3. Pricing and availability All prices are in US dollars. Because items are often unique, an item may sell out while in your cart. We reserve the right to correct pricing errors and to update prices, descriptions, and availability at any time. 4. Orders Your order is an offer to buy. We reserve the right to accept, refuse, or cancel any order — for example, in cases of suspected fraud, pricing errors, or item unavailability. If we cancel an order you’ve paid for, we’ll refund you in full. 5. Payment Payment is processed securely at checkout through our payment provider. By providing payment information, you confirm you’re authorized to use it. 6. Shipping Shipping is governed by our Shipping Policy. We currently ship within the United States only. 7. Risk of loss Title and risk of loss pass to you upon delivery by the carrier to the address you provided at checkout. Once a carrier records an order as delivered, K1ndly is not responsible for its loss or theft, and we are not able to refund or replace it. Where an order is confirmed lost in transit and was never recorded as delivered, our Shipping Policy applies and we will make it right. You are responsible for the accuracy of the address you provide; we are not able to reroute or refund orders sent to an address entered incorrectly. 8. Returns and store credit Returns are governed by our Refund & Return Policy. In summary: Eligible items may be returned within 14 days of delivery using a prepaid label we provide at no cost to you, and approved returns are refunded as store credit, which does not expire. Items marked Final Sale are not returnable. Where an order is wrong, damaged in transit, materially not as described, or confirmed lost in transit, we will refund to your original payment method, replace the item where one exists, or issue store credit — at your option. Free return shipping is offered in good faith. We reserve the right to limit or decline returns on accounts with an unusually high rate of return activity, and will contact you before doing so. Store credit has no cash value, is not transferable, and cannot be redeemed for cash except where required by law. 9. Intellectual property The K1ndly name, logo, Site content, and product photography are the property of K1ndly LLC and may not be used without our written permission. 10. Acceptable use You agree not to use the Site for any unlawful purpose, to interfere with its operation, or to attempt to gain unauthorized access to our systems. 11. Disclaimers The Site and all items are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose — recognizing that our items are pre-owned and sold as described. 12. Limitation of liability To the fullest extent permitted by law, K1ndly will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of our products. Our total liability for any claim will not exceed the greater of (a) the amount you paid for the item at issue, (b) the total amounts you paid to K1ndly in the twelve months before the claim arose, or (c) one hundred US dollars ($100). 13. Governing law These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any disputes will be handled in the state or federal courts located in Arizona. 14. General Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full force. Entire agreement. These Terms, together with our Refund & Return Policy, Shipping Policy, and Privacy Policy, are the entire agreement between you and K1ndly regarding the Site and supersede any prior understanding. Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of the business. Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later. 15. Changes We may update these Terms at any time; the “Effective date” above reflects the latest version.
